phpark3's total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the total amount deposited by you into your phpark3 account in the thirty (30) days immediately preceding the event giving rise to the claim.
The phpark3 Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. phpark3 does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

If a dispute cannot be resolved informally, the parties agree to submit to the exclusive jurisdiction of the competent courts of the Republic of the Philippines. Nothing in this clause shall prevent phpark3 from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.
To the extent permitted by applicable law, you agree that any claim or cause of action arising out of or related to your use of the phpark3 Platform must be filed within one (1) year after such claim or cause of action arose, or be forever barred.
